Do I have a malpractice case?
Anonymous4 views4 answers
I recently had a complete hysterectomy. During the procedure my bladder was cut and had to be repaired during the surgery by a urologist which brought on other complications and longer recovery time. It has only been 3 months but I now suffer from bladder spasms and over active bladder. During my last appointment the urologist mentioned how the repair to my bladder was from a 4 inch cut at a diagonal, he mentioned it was one of the more complex repairs he has had. I remember my gynecologist just kept apologizing after the surgery. I know this can be a possible complication from what I have read but something doesn't seem right. Everyone tells me I should sue?

Yes, bladder perforations can be risks of hysterectomies, but there still may be a possible medical malpractice claim. You should consult with a medical malpractice lawyer with experience in these types of actions and ask for a free consultation. If the first lawyer does not think you have a viable case, I would consult with at least one more lawyer. If the answer by the lawyers is "no" all around, you will have your answer about whether or not you have a malpractice case.

Your research is accurate. Bladder laceration during hysterectomy is a recognized complication. That said, without reviewing records it would be difficult to render an opinion if the Dr deviated from prevailing standards of care. Medical malpractice attorneys generally do not charge a fee to evaluate a potential claim. I suggest you contact an attorney who specializes in medical malpractice to explore your rights.

I'm sorry to hear about this. Although without a permanent injury, the costs could exceed a recovery, assuming there was a breach of the standard of care, have a local malpractice lawyer order your records to investigate. has a great lawyer finder tool to locate a local attorney.

You should consult a medical malpractice attorney. They will get your medical records reviewed and then a determination can be made on whether to sue.
