Question on Bond/Insurance Money.

Business 2 views 3 answers
I am a victim of crime/fraud committed by a notary public who endorsed 2 fraudulent affidavits which affected me/my property. The 2 affidavits were filed within a span of 30 days. The bonding company has a 10,000$ bond on the notary. So if the bond money is to be released for the violations/fraud, am I eligible for 2x10,000$ or just one 10,000$. Your help is greatly appreciated. The state department of insurance is currently investigating my complaint against the bonding company for not releasing the bond money.

If you are the victim of a fraud then you are certainly entitled to compensation. It's nice that there is a bond on the notary to guarantee you $10,0000 but if you filed a lawsuit the bond does not limit your Judgment amount which would be be compensatory damages plus a request for treble damages and attorney's fees - such request permitted when there is a fraud claim.

While an insurance pocket is nice, how about seeking restitution from the person who signed the documents? Is that person being prosecuted?
