You do not say, however, for the purpose of this question I will assume that your son is a minor. You have to file a petition for a name change in family court. You also do not say whether or not the boyfriend is the biological father of your son. If he is not, then the biological father will have to be served with the pleadings and he will have a right to appear and contest the name change. The family court may also appoint a Guardian ad Litem to represent the interest of the child. If the boyfriend is the natural father of your child, then this should go smoothly.

To avoid any drama, get married, have your new husband adopt and the name change will be done at that time. Any other approach may be questioned as alias fraud and that can get real difficult for your son.
