Are we able to sue our son's public school for punitive damages?

Our teenager was using a planer in tech class. He was not supervised by the tech teacher who gave permission to the older students to work on their projects on their own. Our son was using the planer incorrectly and lost his balance when the piece of wood kicked back because the blade was dull. His hand went forward and hit the saw blade. The guard on the blade has not worked properly for at least a year and the spring tension doesn't work. The blade took off the entire nail on his middle finger and the very tip.

The government does not pay punitive damages. Unless they pass a law that says they will pay them. Which they generally do not.

You may not get punitive damages but you should contact an attorney to review the case. It certainly seems like you may have a viable negligence case against the school for your son's injuries.

This is a negligence action not one for punitive damages. Although an unfortunate incident, your only ability to prosecute an action would arise under a theory of negligence. There are time constraints and a condition precedent to bring a claim against a public school so I advise you consult with an attorney as soon as possible.

From the information provided, it sounds like a viable negligence case, but I do not see grounds for punitive damages.
