If you just ask for two million dollars, without supporting documentation and legal arguments to support your position, they won't even bother to laugh at you... they'll just ignore you. You need a lawyer to fully evaluate your case and advise you what it's worth. Act quickly. You may already have waited too long.

Many factors go into what a lawyer asks a jury to award. You need to delineate the economic (special) damages, including medical expense (not what was billed, but what was paid or the reasonable value of the services), future medical expense, past loss of earnings, and future loss of earnings. You then argue for general damages for pain and suffering. You can ask for whatever sum you wish. It is up to the jury to make the final award.

A plethora of factors go into putting a number on a case, and a local lawyer should be retained to investigate and evaluate. has a great lawyer finder tool.

I agree with my colleagues. You need supporting documentation in the form of doctor's reports, surgery recommendations, and most importantly: causation. Your doctors should link your injuries to the incident you believe caused them. $2,000,000 is not that much money for two spinal surgeries and a lifetime of chronic pain. We recently asked a jury for $17,000,000 for three surgeries and similar pain, and they awarded us every penny. In the end, I would recommend getting an attorney to help you gather the documents and send out a meaningful demand.

You may ask for whatever dollar amount you want. Whether the defense will laugh at you depends on what you can prove. You must prove that the accident caused your injuries and you must prove the nature and extent of those injuries. To be successful in your quest you will need two things. First you need a good attorney who will file the lawsuit and prosecute the claim. Secondly you will need a large insurance policy which will be sufficient to pay your damages. If your claim is truly worth $2 million but the insurance policy held by the responsible party is only $15,000, you may have rough going finding an attorney to pursue this matter to judgment because generally large judgments are almost worthless against defendants with limited assets.

Most of the attorneys on this site seem to think you are representing yourself. Is that correct? If yes, you need to be guided by the advice of your attorney. If you are not being represented, are you prepared to try your case? Without even getting into the issue of whether a demand of 2 million is outrageous in your case, do you have a defendant who would be good for such a high award? Unless yours is a corporate defendant, most private defendants do not have that much coverage.

It’s not clear whether you have a lawyer. However, it would be a big mistake to represent yourself in a case like this. The amount of money demand is not a precise math equation. The demand should reflect the amount of harm you have suffered, including your economic damages (i.e. reasonable cost of your medical care, necessary future care, past and future lost income, loss of earnings capacity, etc.) and noneconomic damages (i.e. pain, suffering, inconvenience, mental anguish, anxiety, humiliation, disfigurement, etc). The demand should also take into account the strength of liability and causation in your case. In addition, you need to factor in whether you will be able to collect a judgment against the at fault party. Each case is different and there is not a precise formula to figure this out. A personal injury lawyer can help you with this. If you have not contacted a personal injury lawyer, you should contact one right away and request a free consultation.

Do you have a lawyer? If so, talk to him or her about this. Your case could be worth that much or more, it just depends on what's happened to you, how long ago, etc. etc. If you have these very serious injuries but you don't have a lawyer, you're going to have trouble recovering anywhere close to this amount.

We need more facts to assess your case. What caused your neck injury? You have to have a n orthopedic surgeon determine the current and future medical costs. Since you are off work for 5 years and had two surgeries, you should gather all bills and make your demand. You can attach verdicts and settlements cases similar to your case with your demand.
