Question about a restraining order

Business 10 views 4 answers
My sister and I would like to get a restraining order against my ex's girlfriend. She has become confrontational towards me and has been verbally abusive towards me several times. Another incident occurred today in which she got right up in my face about an inch away from my nose yelling and cursing at me in a public place. I told her to stop but she continued. My sister came and intervened and she shoved my sister so hard it threw her several feet as she tried to keep her balance. I am wondering if this incident is enough for us to both get restraining orders against her. We are both afraid because she continues to initiate this type of behavior and we want to put a stop to it. Please advise. Thank you!

One of the requirements of a restraining order is fear for your safety it seems that is present in the incident you described. You and your sister should file a police report for documentation. Then seek the aid of a competent lawyer who is experienced in obtaining Restraining Orders.

Hello, You have enough for a temporary restraining order. Meaning an order until you have a full hearing in front of a judge along with the ex being present. A restraining order alleging fear an violence are usually free to file. I agree with the other attorneys in that it is best to document all encounters and contact. File a police report. Permanent restraining orders are difficult to obtain if you can't prove your case. The burden is on you. Call an attorney and discuss more of the facts so that you can make a more informed decision.
