Can I get Child support while I am pregnant?
Anonymous7 views3 answers
I am from Argentina and my bf is American, He lives in Vail, CO. I was visiting my family back home when I found out I was pregnant and my bf told me to come back to get married and start a family. A week after I came back He told me He lied to me to bring me back to convince me to get an abortion since in my country is not legal. After 3 months of fighting about this situation and since I didn't do what he asked me, he kicked me out of the house in my four month of pregnancy saying this baby is not his. What can I do?

You should consult with an attorney regarding your options. You certainly can initiate a proceeding for paternity in order to legally establish that your boyfriend is the father. That Court would then have the authority to require your boyfriend to contribute towards birth expenses for the child, and towards child support once the child is born. I'm not aware of any authority for a Court to award you child support prior to the birth of your child. Given the situation you describe, you may also have some sort of cause of action against your boyfriend for costs you incurred as a result of his deceiving you into coming back. The cost of pursuing such a civil action, however, may outweigh the potential benefits. A consultation with an experienced family law attorney would help you identify all of your options.
I agree with Dane. Have an attorney help you file a paternity petition now so that he will be required to help you pay for the birth. However, you very much need to consult with an attorney about whether you want to stay in the United States in order to have him pay child support, or if your long term goal is to live in Argentina. This will make a big difference on your choice of what to do now. You really need to consult with an attorney on this issue.
Not when you are pregnant, but immediately upon the birth of the child you get child support. You should file for a paternity test in order to find out if he is the actual father.
