How to speed my green card application, when my husband becomes citizen.

Business 3 views 4 answers
Last year my husband, at that time permanent resident, filled up I-130 application, at it has been approved. I received a letter from National Visa Center to wait until my priority date becomes current. Now, however, my husband is becoming a US citizen, he has his oath next month. What should we do to "upgrade" the petition? 1. Is there any form to fill up to send to the NVC about the change of the status? 2. Or should we just send a normal letter to NVC about the change? What should we state? 3. Who should contact NVC.... me or my husband? Thank you very much!

Are you in the United States or outside of the U.S. as your question is coming from Newport Beach? If you are outside of the U.S. please follow Mr. Behar's answers. However, if you are in the United States, you can now file for adjustment of status with proof of your husband's U.S. citizenship.

1. No. Simply have husband contact the NVC by phone or email to notify. 2. See answer 1 above. Attach copy of husband's Certificate of Naturalization and ask that the petition be now "upgraded" to "Immediate Relative" (IR). 3. Best if the USC does.

Speed up? It is upgraded automatically. All you need to do is let them know when it happens and the file for a visa. It is best to engage an immigration attorney for the smooth sailing.

If you are outside of the U.S. when your husband becomes a U.S. citizen, he should notify the National Visa Center and provide proof of his becoming a U.S. citizen so they can "upgrade" your immigrant visa category and process your case as the immediate relative of a U.S. citizen. If you are in the U.S. when your husband becomes a U.S. citizen, you may be able to apply for adjustment of status. Please contact an immigration attorney to discuss this further.
