That depends on many factors. Contact a local qualified criminal defense attorney to review your case, your options and possible defenses. Many of us offer no charge consultations.

Some counties in your area ( Carbon, for instance) will not grant entry to the ARD program to anyone who has been through it previously, no matter where. Other counties have a 10 year window. It really depends therefore, on where your arrest occurred. As a side note, if you have the police a hard time, you're not going to get the benefit of the doubt. Good luck!

That would depend on your personal circumstances. Contact a local lawyer to see if you are eligible.

Eligibility for ARD program is entirely discretionary, the DA can deny you for any reason it chooses (except discrimination). Likewise, the Judge can elect to deny ARD. Generally, DAs will only allow participation once in ARD, even if the record has been expunged. That does not mean there aren’t other options for you. For one thing, your sentence will likely be that of a first time offender which could even be less fines then ARD costs. Oftentimes DUIs are beatable due to evidentiary reasons. Consult promptly with an attorney to explore your defenses.

Every county has different rules. Most counties will give you ARD once in your life. Others will look back 10 years and give ARD a second time if no record during that period. The odds are against you getting it again but retain a qualified attorney to assist you. Best of luck

As a general rule, you are only entitled to ARD , if you qualify for it , one time in your life regardless of what county it occurs in. Most prosecuting counties will reject you from ARD if you have previously completed the program. You should consult with an attorney to see what options are available to you if your case does not qualify.

Likely not; however, there may be extenuating circumstances favorable to you that would allow for a second bite at the apple. Also, some counties are more suitable than others in requesting a second chance at ARD due to the passage of a significant amount of time since the first ARD.
