I have been living in a home that is being foreclosed on and now the association of the home is coming after me for fees.

We have been living here for about two years, the homeowner stopped collecting rent about a year ago and now the association is coming after me for the back fees and lawyers fees, close to 4k. We are currently working on leaving this home, but the association is threatening eviction, even though we let them know we will be leaving. I wanted to know my rights and the association's lawyers would like to speak to my lawyer. Need advise

The homeowner is responsible for homeowners association fees. The HOA can evict you so start looking around for a new place to live and get out as soon as possible. From a practical standpoint, you still have several months at the very least.

It certainly is a possibility. Just a suggestion: You may want to look into paying. Depending on how long you could remain in possession, $4,000 may be money well spent. From the facts you have provided, you already have had one year of free lodging. This all depends on how far along the foreclosure case is. Talk to a foreclosure or real estate attorney for specific advice.

My fellow attorneys have made a very good point. The stage of the foreclosure process is unrelated to the associations ability to evict. I would hire an attorney to see how long you have with respect to the foreclosure case, which usually take a long time and then perhaps make a deal with the association to pay the assessments in the meantime. Good luck
