Recertification for Disability

Bankruptcy and Debt 6 views 3 answers
I have not had a headache free day within the last 10 years. I have been approved for disability for a year and have recently started seeing a new dr for a second opinion because believe or not I dont like living this way. What she says is that headaches are disabling and I have one everyday but I am not disabled, she thinks working is better, I would love to get back to work but I cant. My doctor that had filled out the disability paper prior is not necessarily treating me but is overseeing my treatment and is still willing to fill out the paperwork. Im just worried this one doctor will screw over my whole entire recertification case when it comes around. Can I just ask her not to fill out paperwork and send medical notes because they speak by themselves. Will she screw up my case?

There is no "recertification" for Social Security Benefits. SSA will from time to time request a Continuing Disability Review (CDR). They will ask you to sign a document allowing them to request medical records. SSA will request the medical records, but they generally do not request a statement about disability from the doctor. A disability examiner will do the review, not a judge. So long as you continue to get regular treatment and your condition remains unchanged you should be fine. However, SSA can still stop benefits - if this happens read the paperwork carefully about appealing and contact a Social Security attorney in your area. If your benefits are stopped you have the right to a hearing before a judge. One helpful hint - if you don't keep a headache log, you should. You can find a template online. I would do this everyday and give copies to your doctors. It will could help should SSA ever decide to stop your benefits. Good luck.

Just to add, CDRs are supposed to take place every 3 to 5 years and in reality were occurring every 5 to 7 years if not longer. However, with the GOP pushing to get people off the disability rolls, SSA is expending more resources to do CDRs timely.

You simply need to decide if you are happy with your doctor patient relationship. You may want to discuss the situation with the gatekeeper doctor.
