Bill collector harassment
Anonymous3 views4 answers
I had a mammogram done at a hospital and I gave them my insurance card . Someone wrote down the wrong info and the hospital sent it to a collection agency. I kept receiving calls from the collection agency saying that the insurance company said that I wasn't covered. I finally gave them the direct number and they had me on a 3 way call that's when the insurance company and me found out that they the wrong number for my claim. Now the collection agency has derogative info on my credit report. What can I do? Can I file a complaint? And if so, against who?

I hope you are well. First contact the collection agency in writing stating that you dispute the debt and to cease phone call communication with you and to send you proof that you owe it. That should take 10 minutes. Second, call them and tell them to stop calling you and that you dispute the debt and that you proof that you owe it. That should take 5 minutes. Keep the conversation short and sweet. Third, send a dispute to all three credit reporting agencies disputing the debt and highlight the error of the insurance company. That should take another five minutes. Fourth, send the same correspondence to the insurance company. Fifth, when they violate by calling you or harassing you, sue under the FDCPA, the Illinois Consumer Fraud Act (ICFA) and bring in the credit reporting company under what is known as the FCRA. If the account entry was an error and you verified it was an error with the insurance company and the insurance company lists the error again then you have a claim against the credit reporting agencies, the insurance company and the debt collectors. See our book at Sulaimanlaw.com for the section on FCRA and FDCPA and the interplay of ICFA. A consumer attorney can help here and they usually do not charge unless they collect. It is worth it for them because they collect from those they sue. Turn your frustration into resolution and a payout. I hope this helps. Ahmad
You can dispute the entry on your credit report with each of the credit reporting bureaus, that would be a good place to start. If there are subsequent violations, you can consult with a consumer attorney,
Contact the collection agency and the credit reporting company. Dispute the record. Hire as consumer debt attorney if you do not get satisfaction doing this yourself.
See a consumer law attorney. You may have claims against them under the Fair Debt Collection Practices Act, and the Fair Credit Reporting Act (if you dispute their tradelines with the credit bureaus and they verify the information). Most will provide a free consultation and take cases of that nature on a contingency basis. You have a right to ask the collector to stop calling, but if you want to get the billing problem corrected and your credit corrected, that might not be the best course of action right now.
