You must file a Motion to Dismiss within 30 days of filing your Appearance. You can not assume a Court will consider or grant your Motion to Dismiss if filed after the 30 days from your Appearance. You can file a Motion for Extension of Time to Plead - however, you run the risk of the plaintiff filing a Motion for Default for Failure to Plead, and the Clerk granting it, before your Motion is acted upon. IF that occurs, a Request to Revise and Motion to Strike will not be considered. Therefore, you should 1. file a Motion to Dismiss within 30 days of the filing of your Appearance, and 2. file a Motion for Extension of Time to Plead within 30 days of the filing of your Appearance. Good luck.
