Getting out of a QDRO

Divorce 2 views 3 answers
I got divorced in 1994 and had a QDRO done in Florida. Is there any way out. My ex wife has been getting half my pension for over 20 yr.

Given the amount of time that has passed, it is not likely there is anything you can do to change an award of property over 20 years later.

It is unlikely that you will be able to undo a QDRO this long after the original divorce action. The only possibility that you have is to go back to court in Florida and perhaps plead extreme change in circumstances which were unanticipated. This would not be merely that you have now retired and she is getting your pension but something unusual and untoward has happened or perhaps her financial situation has become such that things might be changeable. An experienced Florida divorce lawyer is someone you would need to see. Ordinarily property awards are not changeable so unless you have extreme circumstances and that means other than just not wanting her to have the money you are probably unlikely to get anywhere.
