Plead Guilty to Aggravated Assault 2F with use of deadly weapon knife in open court waived right to jury trial and asked for adjudication of sentence or probation. prior felony 5 years plus probation and DWI. Court accepted plea of guilt with stipulation of plea and evidence. The court ordered PSI and will do final sentencing in March. Why if I waived a PSI is one being done and how will that impact my sentence and could I get probation if they are going to use witness statements crime scene photos and so forth especially since I plead guilty to causing bodily harm or injury by cutting or stabbing with a knife and using a deadly weapon in the commission of the offense. Had an attorney who was present when I plead guilty Also Owe child support in excess of $8000.00 my prior felony conviction for drug possession and my prior conviction for DWI/DUI was/is being used as well as witness statements, crime scene evidence and the fact that I stated in open court that I intentionally caused knowing bodily harm or injury with the use of a knife. On bond with the stipulation that I have no contact with the victim or the witness and that I abstain from alcohol or being anywhere near the victim or the witness. I turned down an initial plea deal for 2 years in TDCJ and SAFP in lieu of a jury trial originally and have after talking with the attorney representing me rather than go to court I plead guilty to Aggravated Assault 2F with the use of a deadly weapon (knife) in the commission of the assault. The DA made no sentencing recommendations and no plea bargain was reached as I turned it down the first time.

These are great questions for your attorney. YOu did have one right? Big mistake if not and not understanding these questions is exactly why people should have attorneys.

You are in need of an attorney. Retain a criminal defense attorney to represent you.

You should ask your attirney. I think he would say every felony court requires a PSI.

The court cannot give you deferred, or straight probation when there is an allegation of deadly weapon, and the court found that a deadly weapon was used. See Tex. Code Crim. Proc. Art. 42.12 (3)(g)(2). Limitation on Court Ordered Community Supervision
