Method of payment for Child support

2 views 3 answers
I have a job with a manufacturing company but need to keep changing hiring companies to keep my job. My ex previously had my wages garnished for child support, but the state's case handler has agreed to allow me to make payments my way as my pay schedule also keeps changing with the companies. Can I not continue making automatic payments to the state directly from my checking account?

I am confused by your question. If the State's case worker has agreed to make payments via auto withdrawals from your checking account, what has changed? I would suggest taking your information to a local attorney who is familiar with family law and ask for personalized advice given the specific facts of your case. Many attorneys will offer a free consultation and this may be just the amount of advice you need to get things figured out.

You can set up automatic payments with your bank to send money to the State. You can, assuming the State agrees, send money more on your schedule, similar to a "bill pay" which most banks allow. Look at your order of Child support which will tell you if you have to pay support to a particular place. It would seem that you must have been delinquent in support payments at some point, otherwise your former wife could not garnish you. Did she then get some court order allowing her to require direct payments? Work with a good lawyer and they can modify your support order to accommodate a payment method that works. However, if you do not live up to it faithfully you can expect to have trouble in the future.

Be careful. Your agreement with the state DCS employee does not prevent arrears from accumulating under the current court order.
