E3 Visa status upon job termination

“Hello, my husband and I are here from Australia on an E3 & E3D respecively. It is valid until September 2016. Last week he was laid off with 2 weeks notice and 90 days severance. That means his termination date is Feb 3. What date are we allowed to legally remain in the USA. We have a home, cars and goods to sell if we are to leave and 2 weeks doesn't seem reasonable timeframe to do this. Can we remain in the US for length of I-94 permit?”

Once your husband stops working for his E-3 employer, his (and your) status will terminate - sounds like his last day of work is February 3. Unfortunately, the law does not allow for any grace period in this situation. You may want to consider filing an application to change your status to visitor (B-2) to allow you time to settle your affairs in the U.S. best to consult with an immigration attorney to review all the options available to you and your options.
