What happens after my ex broke into my house to get his belongings?

My ex broke into my house using a crowbar, damaging my door. The only things he took were his own possessions. I called a police officer out and filed a report. What is the typical criminal procedure for this situation, and can I file a civil claim if the detective deems there is not enough evidence to support the claim?

There really isn't anything typical about this situation. If the detective determines that there isn't enough evidence to file criminal charges it would probably be hard for the insurance agent to prove. You need to give the detective as much information as possible.

(1) The officer will submit your complaint to the District Attorney to accept or reject your claim for prosecution. (2) If the house was your separate property, you may file a civil lawsuit for the damages.

Are you really ex-ed? Or are you the ex-term loosely meaning he is your future hoped to be -ex? If he is truly your ex you probably have a burglary complaint, especially if you were awarded the house. If he is not your ex and/or that is still marital property, then he properly could not burglarize yours and his jointly owned house. As far as his possessions, if they were his or marital property he probably could not steal them. But go to the police and make a report and let them determine it. After that go see family law counsel and make him your ex- if he is not ex-ed yet.

If he lived there and you locked him out he might be able to claim he was a tenant.
