Sorry to hear about this. It is tough to tell you what the judge will do with you without knowing more of your history. I strongly suggest you attend a few AA meetings today and tomorrow before court on 2/12. Bring the sign-in sheet to court to show the judge and hope he thinks you have an earnest desire to overcome your apparent alcohol issues. Good luck to you.

I agree that it is tough to predict what will occur at the next court appearance. Hopefully have have a retained or appointed attorney and they will have more insight into the situation, so update them with this information immediately. If you are in the very unfortunate situation where you did not already retain counsel or have one appointed, then call and retain counsel immediately.

If you are unable to retain a lawyer by the 12th, you should be prepared to demand an appointed lawyer when you go to court. You are facing revocation of your bond, or revocation of probation. Either way, you could be sent to jail and held without bond or held with a very high bond. A lawyer will be critical to act as a buffer between you and a very angry judge or prosecutor. The goal will be to buy you some time to show that the drug test was inaccurate or that you are taking steps to address the conduct which led to the failed test.

The short answer is that you will likely be prosecuted for the charge of underage drinking that was set to be dismissed. This will occur because you failed to successfully complete rehabilitation. You have designated your question under the subject "DUI." Tenn. Code Ann. § 55-10-415 provides that If you were driving while intoxicated and was eighteen (18) years of age or older but under twenty-one (21) years of age, the punishment is a Class A misdemeanor punishable only by a driver license suspension of one (1) year and by a fine of two hundred fifty dollars ($250). As additional punishment, the court may impose public service work. No jail time is authorized. I advise you to seek the assistance of an attorney regardless of the behavior that caused you to be criminally charged.
