My spouse's Death Certificate has his ex wife as surviving widow. How can I fix this?

I married a man in Dominican Republic. We were married for 6 months before he died. He died while in NYC and I was unable to attend due to immigration issues. I am now here in NYC and received the death certificate and it lists his exwife as surviving widow. I asked the Department of Health to change it but they said only the next of kin (his daughter) can change it. I explained to them that as wife i should be next of kin but they insist i talk to the daughter to change it. She refuses to do so because she hates me. I wanted to apply for Social Security Survivors benefits. What can I do?

You should consult an estate attorney. Take your marriage certificate to prove that you were married. A death certificate can be amended - but it may take awhile in New York because the doctor who signed the original death certificate has to be contacted to sign the amended death certificate.
