If you are have a clean record, never been in no trouble with the law but you were charged with a 3rd degree felony for insurance fraud and your a first time offender is it possible your lawyer can fight off the possibility of jail time?

I would say its possible. Call a local attorney.

Yes. You sound like a good candidate for the pre-trial intervention (PTI) program. This will allow you to avoid jail and a felony charge on your record. Either way, even if you are convicted of a third degree crime, there is a presumption of non-incarceration for first time offenders. As a result, it is very unlikely you'll be sentenced to jail time.

Anything is possible. Only those who have the value of knowing all the facts and reviewing the discovery can give you a certain answer. An attorney will always help to decrease or avoid jail time and other penalties.

It is likely. A first time offender charged with a third degree crime is presumed not to go to prison and is a good candidate for pre trial intervention.
