My ex filed a Motion to Set Aside Order of Dismissal. Can I object?

Child Support 3 views 3 answers
My ex did nothing with her child support modification and the courts closed the case. Now she wants it reopened and her back child support to date back to the original filing date (over a year ago). Can I file an objection to this? And, if so, is there any key information I should include?

You can't really object to her filing a motion (although there are some instances where that is possible). You can argue that the case was properly dismissed. You should contact a local family law attorney to discuss this issue.

You have raised a great question. I suppose it is possible, but it will be specific to your case. I encourage you to meet with an experienced local attorney to help you. Wishing you all the best. David A. Carroll

Check with an attorney to see what your procedural options are. Generally, a counter-filing may be submitted to set out your arguments as to why the motion should not be granted. A Florida attorney will be able to explain your options.
