My spouse promised (in writing) to pay for graduate school for me if I would support him through medical school.

Shortly after he completed medical school, we divorced and he reneged on his promise. I sued him and was awarded $100,000 through mediation. Will this be taxable?

There are not enough facts provided to give a definitive answer. To explain, was the $100,000 alimony or a division of property? If alimony, it will be deductible by him and includible by you in your income. This is for informational purposes only and should not be relied upon by anyone as legal advice.

As the other attorneys have said, it depends on how it is labeled. Is it spousal support or some kind of payment to equalize your property? Only spousal support is taxable. But your attorney's fees to get he spousal support may be tax deductible so consult a tax professional. Property distributions or child support are not taxed and some spousal support provisions provide that the payments are not deductions for the payor or taxable income to the payee.
