He falsely accused me of with holding the children from him.. Only presented his witness statement from local police as his evidence & I provided the court with the actual police report that showed I did not keep the children from him. There is a strict parenting plan that his lawyer drew up because I was forced to be pro se & did telephonic hearings. All I did was follow the parenting plan. I am in MA & he is in FL where the divorce happened. The local police stopped him from taking the children back to FL. I provided the actual police report & the parenting plan and some how the judge found me not credible & awarded him the Temporary order. He's now been carrying this order around in order to not pay child support.. How long does this type of order last. What can I do
It depends on how long the children have been out of the State of Florida. If more that 6 months, Florida has presumably lost jurisdiction over your case.
Generally speaking, the court that enters the final judgment retains jurisdiction to modify and/or enforce it.
You should retain the services of experienced local (Florida) counsel to assist you in this matter.
It is not clear from you question whether the temporary order ABATES his child support obligation or not. In any case, you need to file a motion and set it for hearing, or request a trial date. Which path to take depends on what is actually pending before the court, and your attorney would be able to assist you with that decision after reviewing the file.
