How can someone have a warrant for failure to appear on a court date that was cancelled?

My friend had a court date for driving while their license was suspended. When they looked on the hillsclerk.com website, it said the court date was cancelled so they didn't go. Now, they have a warrant for failure to appear. How is this possible?

It happens. Hire an attorney so that these things don't happen again in the future. An attorney can have an affidavit and authority to represent in court and if the client does not appear, can possibly ask for the case to be continued. Your friend simply relied on something on a website that may or may not have been correct or updated. To avoid having to turn yourself into the jail or being arrested: Hire an attorney to file a motion to set aside to the bench warrant for failure to appear. then the attorney could actually defend the rest of the case and possibly get him out of the problem completely.

the website may have been mistaken or your friend may have misread the information contained on it. hire an attorney and try to set a surrender before the court. the judge may withdraw the warrant upon hearing your friend's testimoney. do it soon, because the state could file an additional criminal charge of failing to appear. good luck

I agree with the other attorneys that this does happen sometimes. The clerk's website is not always up to date or accurate. You should contact an attorney right away to deal with this matter if you so that it is taken care of properly. The attorney can file a motion and schedule a hearing so that when you turn yourself in on the warrant you spend very little time at the jail. Most attorneys offer a free initial consultation. Good luck. Sincerely, B. Elaine Jones, Esq.
