It's dad's weekend (Fri to Sun), I've asked for swap or make up days at his own choosing, he refused.

You would need to file a motion with the court seeking the temporary visitation. You will need to be prepared to include your proposed plan for exchange, transportation, and any of the other issues unique to your case. Keep in mind that this motion will likely require a hearing and you have the obligation of trying to schedule such a hearing. Don't assume that it will be set for a hearing simply because you file a motion. Also, it can take a very long time to secure hearing time, so you should avoid any delays. You should probably have an attorney handle this for you.

If there is already a timesharing schedule, then the father is not required to swap weekends with you. That being said, it is very unfortunate that he is taking that stance. If you do not yet have a final agreement and it is a temporary timesharing schedule until your divorce or paternity matter is fully resolved, you can bring this type of behavior up at the trial to show that the father is unwilling to foster a good relationship and to show that he is not willing to be flexible for the best interest of the minor child.

You only recourse really is to file a motion. The reality is you will probably not get into Court to have the motion heard until the time you wanted is already gone. On the flip side of things, you don't have to swap with him anymore when he requests you to. Unfortunately, when parents take stands like this, the child is the one who ends up getting hurt because they miss out on the event. Good luck. Sincerely, B. Elaine Jones, Esq.
