I was in a car accident where someone went around about 3 people at a stop sign doing 40 in a 25 and hit me. My 6 month old son is okay but i now have 2 herniated disc and one bulging in my neck (have to get aother mri for back). I live in new jersey and looked up cases but everyone who won i see had surgery. I am petrified and refuse although it hasnt been brought up. If down the line it is recommended and i say no can i still sue. Also, my car is totaled!

No, you don't need to have surgery. Herniations can yield big settlements and verdicts without surgery. You should retain a personal injury lawyer as soon as possible though.
No, you don't need surgery to "win" a case, but you do need a permanent injury in most cases. Call an experienced personal injury lawyer for a free phone consultation.

You do not have to have surgery to be awarded monetary compensation for pain and suffering. It does raise the value of your case a great deal. However, most off my clients do not have surgery amd are successful in there cases
The driving misconduct of the defendant was aggravated and could well merit a larger recovery. Further, your future physical condition and treatment plan could be a dangerous wildcard. Obtain counsel to help evaluate this complex of medical issues.
Seriously? Are you even considering having surgery to increase the value of your case? You should get the medical care you need to get better not "make" a better case.
From your post it does not appear you are being represented by a lawyer. Instead of doing research on how to enhance the value of your case, you should be doing research to find the best personal injury lawyer in your area to represent you.
Glad your son is okay. However, your case can be worth a lot of money. A fractured leg with surgery heals pretty well. However, some disc herniations never heal properly. The value of your case depends on the severity of your pain and the restrictions in what you can and can only do with difficulty. Do not fall into the trap of trying to handle your case without a lawyer. The one third fee experienced trial lawyers charge is well worth your while. And you don't need to advance any costs.

Your main concern should be tending to your injuries such that you make the best possible recovery. You do not need to have surgery to obtain a settlement or verdict. You should immediately consult an attorney who is a member of the New Jersey Association for Justice for a free consultation to advise you of your rights.
First, let me say that I'm sorry to hear about your accident, and I'm glad your little boy is okay (though I hope you did get him examined by a doctor just to be sure). You do not have to have a surgery to win a case. Now, if down the line your doctors recommend surgery and you decline, then your claim would have a lower value than it would if you went through with the surgery, but you could still pursue it. (This is likely why you are seeing mostly examples of cases in which the victim had surgery -- because these claims tend to result in a higher settlement or trial verdict.) Our office has handled cases like yours where a client decided, for whatever reason, not to undergo surgery. Ultimately, it's your health and your decision, although it's a decision you should only make after discussing it thoroughly with your doctor. When it comes to choosing what medical care is appropriate for you, base those decisions on your recovery and future health, not the possibility of a lawsuit. Since you are thinking that you could need to pursue a claim, though, I would suggest that you start looking for an attorney now so that if you have any questions in the future, you have someone to turn to who already knows the facts of your situation and who can advise you personally. You can use the Find a Lawyer tool here on to locate an attorney with a high rating and experience handling herniated disc cases. Good luck with your recovery and your claim!
