Someone is about to sue me from out of state. Can I sue first?

I hired a CPA in another state. I feel they are billing me unfairly and owe me a refund. They are threatening to sue for non-payment of a balance owed. We do not have a contract for services, as it was a 1 time service. If I sue first in my own state will that control the venue or can they move it to their state where the service actually took place? I'm more concerned about where the lawsuit will take place (small claims). According to them it is going to happen. Q: Should I sue first?

If you hired a lawyer in another state and all of the work was done in the other state and PA has nothing to do w/this claim but for you living there....then you can sue there but when you serve the CPA he will seek to move it to whatever state the CPA is in and more likely than not, a Court will agree with him. You should cut a deal w/the CPA and save both of you the time and hassle of litigation. Good luck
