This depends on a number of things. It may be that your own insurance would cover your damages. It may be that there are other parties who can be held responsible depending on all the circumstances. It may be that the other party has assets that could be reached. The only way to properly evaluate the issue that exist in your particular case is to quickly have your case reviewed by a qualified personal injury attorney in your area. The ability to recover damages in a personal injury case can have very short statutes of limitations, and even shorter if there is a potential claim against a municality or other governmental entity (such as if there was a defectively designed intersection or missing stop sign). Please contact a personal injury attorney quickly. Most will even come to you if you are unable to go to them, and generally they take cases on contingent fees, so there is no fee if there is no recovery. I am very sorry that you have sustained such serious damage and hope that with proper legal assistance you can improve the result.

Adding to Margery's answer above: You need to check your insurance policy's declarations page and determine if you have Underinsured Motorist Coverage. If you do, and your limits are higher than the bodily injury limits of the offending vehicle's insurance, you can bring a claim for Underinsured Motorist Benefits under your own policy. This is usually done first with written notice to your carrier that advises that your will be pursuing these benefits and second, filing a demand with the American Arbitration Association. The written notice to your insurance carrier must be done timely pursuant to the conditions listed under the UM endorsement. The demand for arbitration must be filed within six years of the date of accident. If you need any further assistance, please feel free to contact me. I have 14 years of experience handling UM/SUM matters.
