Are there any other options than divorce?

I got married 9-20-01 after 3 months he left and I haven't seen him since. I know he's still alive because I have tracked into other states. I know he has been married again since me. We didn't have children or things. I would like the ability to move further in the relationship I'm in now. I don't have money much money for a divorce. What can I do?

Depending on what you want to do, there's probably not another option. Unless your husband obtained a default divorce without you being aware of it, you are still married. His new "marriage" is not legal and he could possibly be charged with bigamy as a crime. You could look at some forms approved by the Texas Supreme Court: http://texaslawhelp.org/resource/texas-supreme-...

You just need to retain family law counsel if possible. Get a divorce filed. Plead any jurisdiction facts you have over him if he ever had any minimum contacts with Texas. Did you have any child since you married him? If you did, he is that child's presumed father. If not, you have no parent-child issues in the divorce. Service appears to be by publication on a due diligence affidavit, and an attorney ad litem will be appointed for him after publication service in a Jefferson County/Beaumont newspaper one time. You hopefully have acquired no property since 9/20/2001, but if you have it is presumed community property and probably is community property and you want the court to award it to you. It may seem simple, but it has its share of complications and potential traps. Please consult with family law counsel and get it done because clearly the marriage is insupportable and needs to be laid to rest, and delaying this just creates more complications and entanglements between you and a virtually non-existent spouse. If you have any way to locate him and get him personally served since you have tracked him and are concluding he is living, you should have him personally served because that is the most air-tight final and complete divorce and resolution of your legal business with him.

You need to get a divorce. If you are low on funds I would suggest making an appointment with several lawyers until you find one that meets your budget. You might qualify for s pro bono lawyer here is a link to the pro bono page. http://www.jcba.org/?page=A6 Good luck.

An annulment. Check with a lawyer and see if your facts fit. Also see if your husband would agree to it. Otherwise, go with a divorce. Good luck! Charles

Divorce or Annulment are your only two choices. Without more facts, I'm unable to tell if you meet the requirements for an Annulment. Sounds like your case will have possible jurisdictional and service of process issues. Not sure the forms will be adequate. Please consult with an attorney in your area as most are willing to meet with you free of charge.
