My dad pulled a gun on some of our family members. What should happen?

Domestic Violence 4 views 4 answers
My grandmother moved from her home about a week ago, which is on my mom and dads property. She and my aunt and uncle went back to get her stuff a couple days ago. While there, my dad pulls up and puts a gun in there face telling them to leave. They did not give him reason, at all, to do this. He came from out of no where, put a gun in their face, telling them to leave. They called the police, but the ones that came attend church with my dad and mom, so they simply would not do anything. I just want to know should they have done something? What can my grandmother do about this? It just feels to me as the situation was not handled right. The cops did not even take reports from my aunt and uncle. It seems as if they are covering for my dad. Please let me know, what you think should happen?

When a gun is pulled, it is serious. Consider a restraining order and/or family counseling.

Pointing or Aiming Gun or Pistol at Another is a crime in Georgia (when all elements are present). While I cannot say for certain why your father was not arrested and charged with that crime, your grandmother does have the option of filing for a Temporary Protective Order as soon as possible, if she is concerned for her future safety due to this incident. An ex-parte (one-sided) order will be put in place temporarily and she would get a hearing within about 10 days (as it is an emergency situation). At that hearing, unless your father consents to the TPO, she would have to present evidence to substantiate her claims. Your father would be able to rebut those claims and at the end the Judge would make a ruling. If the TPO is granted, it will be in place for 12 months. I wish your family all the best.

Your grandmother should consider taking out criminal charges by herself via the criminal warrant application process through the magistrate court. She can also apply for a temporary protective order.

I'm surprised your dad was not arrested. Your grandmother can go to the magistrate court in the county where this occurred, and file a warrant application for his arrest.
