Are fingerprint and background check required for my name change, if going back to my exhusband last time?

My ex and I divorced and because I never changed any identifications to his last time during the marriage, my maiden didn't have to be restored in our final divorce decree. Will a fingerprint and background be required to go back to his last name? Thank you for your response and for this service.

Typically this is not required for a name change. However your fact pattern does not make it clear if you are currently married. If you re-married your husband you should be able to go through the normal process.

Yes you would need to follow the normal process of Petitioning the court for a name change outside of a divorce action. This will require finger printing and a law enforcement back ground check. Sincerely, Daniel Bachert, Esq.
