How to obtain my license back after a DUI?

5 views 5 answers
I was pulled over for DUI at age 20 (2 months before 21 birthday), however i wasn't notified of any charges or filed convictions for a year by the court. My license was suspended for a year, and now the year is up from the day that i got pulled over and i was informed of the statue of limitation law. Does that mean that i would not have anything on my driving record, and is there any extra step for me to get my license back, or i could just walk into a DMV and they can just reissue me my license back?

Go to DMV and run an H6. If your license was taken away 30 days after the date of the event. Than one year after the expiration of the 30 days pay the 125.00 reinstatement fee and show an SR-22 and you will get your license back. Good luck. I hope this helps?

The failure of the DA to file charges does not mean your DMV history is clean. To get your license back you need to pay a $125 license reissue fee and show proof of insurance through an SR-22 form filed electronically in Sacramento, usually done so by your insurance agent. You may also have to show proof of attending an alcohol awareness class - a DMV requirement. Check with the DMV on this. Good luck.

The Year is actually not up from the day you got pulled over as the suspension begins one month after the arrest unless later if there was a stay of the suspension requested in order to conduct a hearing. As the other attorneys indicated you would need the SR22 and pay a reissue fee. If there was no conviction you would not have an alcohol class to attend. Also, your DMV record will indicate a DUI and it will stay on your record and be a priorable offense if you get another suspension or conviction in the eyes of the DMV.

You need to go to DMV and pay a reissue fee and show proof of insurance. Depending on the statement made by the officer, DMV may require you to attend alcohol classes. Good luck!
