Does it matter if your attorney didn't file an appearance in circuit court?

I had a private attorney represent me in the circuit court concerning a petition for post conviction relief and the clerks office recently sent me notice stating that my case has officially been moved over to the appealtte courts and also pointed out that my attorney never filed an appearance while in the circuit court. I called the clerks office to inquire about this and they said they could not comment any further on this. I'm hoping this isn't a bad thing as I've already been through so many disappointments; mostly from the prosecutions side of the equation of course. I am currently waiting to find out who my newly appointed attorney will be from the appealatte court during the time being due to becoming indigent. Thank you.

It sounds like you have a criminal case and had a court-appointed lawyer representing you. However, he either never filed an appearance, or he filed a motion to withdraw. Either way, you are without counsel until you get a new lawyer. You should follow up on this. Whoever filed the notice of appeal should be your current attorney.

While it is not clear what is being appealed: conviction, sentence or review of a PC, this one specific detail is unlikely to prejudice your position. Assuming your Notice of Appeal is on file timely, your rights are protected. You can go to the appellate clerk's office and look at your file. Might already have a counsel appointment in there.
