Do I have a case due to a drunk driver?

2 views 5 answers
My family and I (kids 8 and 5) were hit by a drunk driver in a company vehicle. He was said to be going at least 90mph and blew 3x the legal limiT. Thankfully non of us were seriously injured. However, my new vehicle was totalled, I have had terrible depression and stress due to accident, not to mention the kids and I have had emotional stress due to it. I can't find a lawyer because once they hear we don't have $2500 in medical bills they aren't interested in the case, Regardless of the domino effect it's had on everything else. It's been 6 weeks, my vehicle isn't replaced, nor has the companies ins stepped in to offer anything. My ins paid for my truck.

I am not licensed in North Dakota, but in California, there are attorneys who might be interested in representing you. Did the drunk driver have insurance? Was the drunk driver prosecuted? Have you had contact with the prosecutor? You may be entitled to restitution in the criminal case. You ought to check into that for sure.

Unfortunately, you're experiencing how difficult it really is to sue someone. Far different than what you've been lead to believe. You should try at least 3 local/qualified attorneys. Good luck.

You always have a case against a drunk driver. North Dakota and South Dakota have less attorneys than many other states. Keep a sleep log, document any lost sleep, see a phychologist who can help you with the depression, and this will actually generate medical bills. I have handled cases in South Dakota, but not yet in North Dakota, but I am happy to help, if the facts are as bad as you have described, I think you have a strong case of negligence and pain and suffering is available as well as medical bills.

I am Licensed in ND. You do need a threshold to bring suit against the driver. Even though you don't have "medical"l bills, you seem to have suffered an emotional injury. You should not neglect that part of your injury. Good luck.
