Do I need a divorce lawyer?

Bankruptcy and Debt 3 views 6 answers
My ex promised me the 401k in lieu of child support and alimony. When we filed he told me to just agree to everything he put so it wouldn't go to trial, because it would take longer for me to get my money. Once the divorce was final in July 2014 , he said he has no obligation to me anymore. I've talked and talked to him about it and he agreed that he would give me some. At this point I just wanted something ,so I could take care of my son,get transportation, and a job. I need clothes for that. He's lied and lied. Said over and over that he did it,and then comes up with a lie like it went to the wrong address and got sent back. Week after week I'm waiting and hoping he's going to for once do the right thing. But its been 2.5 wks since he said she put it thru. What do I do?

If everything is written and end entered as an order, you should have no issue. If not, you will have a long journey to recover your promised rewards.

You definitely should consult a lawyer. All of your outstanding issues, including custody, child support and disposition of marital assets should have been resolved at the time your divorce was final -- a court wants to ensure that things like child support, etc are not overlooked (and frankly I'm concerned that a court would allow a 401k in lieu of child support). Something seems off as to how things transpired here.

Apparently you are dealing with a very good liar, and when this is the case, you cannot believe a word they say. It appears that your divorce has been really, really messed up because of his lies. You now need an attorney more than ever. You have already waited way too long to get an attorney's help. Hopefully, this mess can be corrected at this late date. I wish you the best.

There appears to be a lot of issues that should have been addressed at the divorce hearing last year that were not. You would do well to bring with you all the court documents (filed by your ex, filed by you, and that the Court provided) and bring them to an attorney to review and discuss what, if any, options you may have.

Contact an experienced family law attorney as fast as you can.If your divorce went through in July 2014 without any of the relief you thought you were going to get, then you may be in a very bad situation, but if there is any hope, it is going to require you act as soon as you can. If your son is a minor you should still be able to get support, but you may be barred from other claims unless part of the Judgment of Divorce. This is exactly the sort of situation which shows why it is so important that someone going through a divorce at least meet with an experienced family law attorney.

You need an in person consultation right away so one of us can see exactly what has been done and what can still be done. Its unclear from what you have said what you are entitled to and what options you may still have.
