It appears that you recovered from a potential lethal dose of anesthesia so I'm not sure that whatever damages/injury you suffered from this horror would justify a claim even if it can still be brought given whatever the ND statute of limitations may be. Hopefully a ND lawyer will weigh in soon w/local knowledge about ND's statute of limitations. Best wishes

If ND statute of limitations is 2 years, then the answer is yes. Always contact local/qualified counsel asap. Good lick.

I'm glad you pulled through, and it depends when your injury was discovered, so have a local malpractice lawyer investigate. has a great "find a lawyer" tool to locate a local lawyer. Good luck.

In North Dakota, a medical malpractice lawsuit must be filed within two years of the date of discovery of the injury, but not more than six years from the date the injury occurred. As your injury occurred more than two years ago, it appears your time to sue has passed. Do not feel badly. I doubt you would have had a viable medical malpractice claim to begin with. "Almost" is never the basis for a personal injury lawsuit.
