Save the screw, and don't give it to them. You can take a photo of it. Get an estimate for the new tooth, and submit it to them. If they don't pay, you can sue.

Preserve all evidence, such as the tooth, photographs, screw, estimates, dentist records, bills, etc. which will be needed for you to build a strong case, if they refuse to pay for the damage of your tooth. You can sue them in small claims court, if damages do not exceed $5,000.

I agree with attorney Christian Lassen who commented that to get the cost of repairing the tooth would be a fair resolution. You might be tempted to compare your case to the famous spilled coffee case, but be cautious. In that case the jury awarded over 2.3 million to a plaintiff who spilled hot coffee on her lap after going through a McDonalds drive through. However the facts in that case were that McDonalds had hundreds of injury reports over a 10 year period resulting from hot coffee spills. Their coffee is heated to 170 degrees rather than the industry standard 140. Their were no hot coffee warnings on their cups. The jury awarded 2.3 million in punitive damages because that's what McDonalds sells in one day.

I had the same case. Look up on google. "Bronx man gets screwed at Wendy's " The insurance company for Wendy's ended up paying a Large Sum for their Negligence in having a screw in the burger that caused a broken tooth. Ken Litman, Esq. How can you sue? Same way everyody else does. Hire a lawyer. That's what we do. You went to a dentist to fix your tooth, right? You didn't just search the 'net to ask a dentist how you can fix it yourself. Same thing with a legal claim.

We have a very similar case. Which McDonalds? Save the screw and take photographs.
