Original Sentence was 75 days because I did 180 in rehab on my own and I was allowed to apply foe SEC house arrest. I didn't enroll in time because of funds, At my PBV hearing I was sentence to 125 days. Can I apply for prop 47? I have a full time job and a family and need to know my options, If any.

Prop 47 does absolutely nothing for you. Prop 47 reclassified some offenses, principally drug possession and theft offenses, from felonies to misdemeanors. A third-time DUI is not a drug possession or a theft offense. A third-time DUI is not a felony. Talk to your lawyer about what sentencing alternatives are available in your county.

Prop 47 has limited crimes that it handles and DUI is not among them. You will do no more than 50%. Less if they are overcrowded.

It is my understanding that Prop 47 deals with felonies, Drug and theft charges. I suggest that you contact a Calif DWI/DUI attorney for a correct answer.

Prop 47 does not apply to DUI's. You will serve a maximum of 50% of the 125 minus any credits for time served. Good luck to you. I hope this helps?

You are not Prop 47 eligible. The other answers specify which type of charges fall under Prop 47 relief. Also, contact an attorney to request alternatives to jail. Good luck,

Prop 47 doesn't apply to DUIS and 125 will net you 62 days. Hire an attorney to get you an extension for SEC.
