Do Band Managers need a Talent Agency license here in Illinois?

Entertainment Law 2 views 3 answers
If a Band Manager charges a commission for each gig, event, or performance of a Musician, Performer, or Artist, do they need any type of license or Talent Agency license? A Talent Agency license is not preferred, only preference is to be a Band Manager or Manager of Artist. Is any type of license required to charge a commission for each gig for Artist as a Manager of the Artist? Looking for basic answers, nothing detailed.

You should read the information at the links provided below. In short, yes, it appears that if a person in Illinois routinely procures employment for others [including a band] then the person must be licensed as a "Private Employment Counselor" working from a business that is licensed as a "Private Employment Agency." Speak with an Illinois-licensed entertainment attorney. Good luck.

As noted, talent management is a regulated industry in a lot of places and my colleague suggests here IL is among them. It is one thing to be a band manager and another to also be a booking agent charging commissions from revenues received. This does not necessarily mean that it would be a big deal, but certainly that you should invest the time, effort and expense in ensuring that you understand the legal landscape and comply before jumping in. In these kind of cases, it doesn't usually come up until there is a lot at stake and if you were not compliant you may lose any and all commissions received and be forced to pay fines, attorney fees, etc. f you need further clarification, I suggest that you consult with a lawyer in private and discuss your objectives in more detail. You can start by calling around to several for a free phone consultation, get some insights then pick the best fit to work with. Best regards, Frank Natoli-Lapin, LLC
