Can I make this to be a simple divorce? do I need a lawyer?

I've been married to my husband since January/2007. We now live in MD. We have no kids, two dogs and living in his parents house for over 5 yrs. He's a functional alcoholic and very angry person. But I haven't been reporting this issue nor talked to anyone legally about this, I don't have any recent proof that he's been angry around me. I have multiple pictures of my broken laptop, and my new car's hood had dents from him punching, he had chocked me, pulled my hair out, pushed me all kinds of stuff that his mom knows about but I don't think she'll agree with me like I want her to. I wanted a divorce since few years ago. My husband said he will let me go if I want to leave but I truly think that that could be a trap where he doesn't agree to it and become controlling again against me.

From your description, it sound like this may be a contested divorce, in which case you will need a lawyer.

You should at least have a consultantion with an attorney so you understand all your rights and options and know what to expect with the court process of there is no agreement reached.

Schedule a consultation with a family lawyer to discuss the difference between a contested and uncontested divorce. An uncontested divorce requires a period of separation of at least one year whereas it sounds like you have grounds to seek an absolute divorce immediately based on cruelty of treatment, etc.

Most couples begin the divorce process by separating from each other. Are you able to move out and support yourself?
