What do you do once you are sued in a small Claims court for $$?
Do you respond with a declaration to Court opposing it?
Do you enclose reason/ proof of payment?
Where & when do you Serve it etc.etc,?”
What is the process?
You need to respond by filing an answer to the allegations. You would file the answer with the court and serve the other party. I suggest that you speak with a local small claims attorney to assist you. You can use 's Find an Attorney Tool to assist you.
In Small Claims cases, there really is no form of Answer. Just gather up your evidence, prepare your defenses and show up to the hearing and explain to the court why you are not responsible.
You can file what is called a Request for Court Order and Answer (the form is available on the court website) if you have some issue you want to bring to the court's attention before the hearing.
As a defendant, you can also file a counterclaim if you have a claim against the claimant. All of the forms have instructions either on them or available.
