Question regarding physical presence and continuous residency to obtain US citizenship
Anonymous4 views3 answers
I was expanding my business overseas and had to travel often. I am a permanent resident for over 5 years and want to apply for my US citizenship. I have always maintained my residence in the US paying all my bills, lease, utilities since I became a permanent resident. I have also spent 35 months out of 60 in the US. The eligibility says I need to be present for more then 30 months. However I have taken 2 separate business trips for 7 months each out of the US in the last 5 years. Can I apply for my citizenship or will this be an issue? Not sure about the exact rule on physical presence. Can some one please advise. The websites contradict each other. Thank you for your help.

You can qualify for naturalization 4 years and one day counting from the day you returned to the USA from your last trip that lasted longer than 180 days.
I agree with my colleague. You will have to figure out the day you got back to the United States from your most recent trip that lasted 180 days or more. Then count 4 years and a day from this date.
Agreed. If the websites you find contradict each other you need to seek an attorney for a consultation on this issue. The State Bar of New York has a number of qualified attorneys they can refer or services they can refer you to. Make sure you hire an attorney and not a paralegal!
