Security deposit refund in CA

I vacated my rental on 3/4/15 and didn't leave the keys. My husband let the landlord know that the keys accidentally got pack and we needed to look for them in storage. She said ok and get them back when you can. We found them and emailed her on 3/10/15 on where to return them. She said to mail them to her. On 3/19/15 she said she doesn't have them when I emailed her asking. First question , can she charge us rent for all this time up to when the keys are acknowledged they are returned? Second, When does the 21 days start from? The day we where out or the day the keys are returned?

Landlord should've changed locks. That she can charge you for. Rent? Not likely. Your 21 days should begin the day you vacated. Of course, you would pay for the 4 days if the month you were there.

Did she say she was charging you rent or are you just nervous she will? If she needed to get into the apartment then she could have gotten a locksmith to open the door and change the lock, but I doubt she didn't have a key unless you changed them without giving her a new set. In order to charge you anything she would have to prove she had a ready, willing and able person to rent the apartment right away to have lost any money over a locked door. Hopefully she won't play games and will simply send you your deposit. Good luck.

The 21 days starts from the day you vacate. Once you told the landlord you were gone, the landlord had every right to, and should have, changed the locks.
