How do you get off being a default father?

Bankruptcy and Debt 4 views 3 answers
I had been added as the default father because my name is in the system, I never took a paternity test nor have a spoke to the woman, but since she said my name and I already have a child support case. They added me as the default father on this lady case. I cant see or talk to her but they are taking money from me. I called and try to get someone to help me on this. They told there nothing I can do and I will continue to pay and it wont be stopping ever. Please help me with advice because I have paid this for too many years and I know this isn't my child. I'm just getting used because my name is in the system. Thank you in advance for your help

There are a lot of moving parts here, but based on the information you provided you can file a motion to ask for a modification (i.e.. made zero) by challenging the paternity through a DNA test. But, if you have established a "parent like relationship"" with the child this could be tougher. Also, the amount of time you have been paying is an obstacle to over come. This is not a do it your self thing. I strongly suggest you speak with an attorney experienced in family law. Many attorneys on , including myself, will give you a free consultation. Good luck.

As Atty Balter has correctly indicated this can be a complicated issue so I suggest you seek the advice of a Family lawyer asap

If you believe you are not the father, you should file for modification and request a paternity evaluation.
