Is it considered Custodial Interference to not respond for specified visitation?

My daughter is to fly to my house on a specific day for a specific amount of time. My ex and I are to converse and confirm travel arrangements no less than 45 days prior to travel via email. I emailed my ex last week with the different flight options for the specific days of our agreement. Though it is earlier than 45 days I did not see a reason to postpone getting tickets. I also sent him a separate email that day regarding a different issue. I received a response to this email, but not the one regarding our daughters travel. I've emailed two more times since then and have not received a response. I'd like to plan our summer, but I don't even know if shes coming because my ex is completely ignoring my emails. Can he ignore them up until the 45 days prior?

My answer to you may boil down to the specific language in the agreement. In your question you state that the travel arrangements must be confirmed within 45 days and in the added information you state that the ticket must be purchased. The two statements aren't necessarily the same. Either way, I would say that your ex would have to confirm his agreement with your elected travel plans but not before the 45 day mark. If he persists in not answering beyond that date then, I agree that Motions for Contempt and Enforcement should be filed and he may be liable for your added costs for travel and legal related to the filings. I hope this helps. Good luck!

Just because you are both required to have the travel plans decided 45 days out does not mean that they MUST be done exactly 45 days out. If his delay causes you increased expense, you should discuss a Motion for Contempt with a local family law attorney.
