What forms need to be filled out in order to transfer residential property into my living trust?

I live in California but my wife and I own a residence in New York. We recently created a living trust and would like to transfer title to ourselves as trustees under our trust but we are not familiar with the forms in New York. What forms would we need to fill out in order to complete this transaction? I have seen the TP-584 and the RP-5217 but want to be sure I submit the correct documents for recording.

You need a New York attorney to prepare a deed to the trust. The attorney should have the forms you need to accompany the transfer to recording.

You can also reach out to a local title company and for a few hundred bucks they will help you prepare and file the forma

Yes, those are the right forms that need to be filed in the county clerk's office. You will also need to complete a deed from you and your wife into the trust. If the trust is a revocable trust you can maintain your social security numbers for the transfer otherwise with an irrevocable trust, a new EIN will be needed. An attorney certified copy of the trust agreement should also be filed with clerk's office too. Keep in mind to check with your insurance carrier before transferring title for insurance rates. Given you live out of state, STAR won't be a consideration. Overall, this is an excellent idea to avoid bringing an ancillary probate proceeding here in New York upon the death of the survivor of both of you to transfer title at that point in time under your Will or to sell to a third party.
