I think that he will be sent back to prison to fulfill the balance of his unserv sentence. Why would Pa. Parole reward him for failing to show up, failing to notify them and possession of pot?

He will probably have to serve the remainder of his sentence in PA. He should contact a PA attorney immediately to represent him on the matter. You might want to consider re-positing this question to PA attorneys instead of NY attorneys to get a better answer to your question. Good luck.

You are asking NY lawyers to guess about what PA may do. I suggest that you re-post your question on the PA page.

I'm licensed in PA and NY. The PO will drop a detainer in him. He will have a Gagnon I hearing and a Gagnon II hearing. The second will generally occur within 30 days of the Gagnon I. The first is to determine if there is sufficient evidence to believe that he violated the terms of his probation (hot-urine, getting arrested) those are Direct violations. Failing to report is a Technical violation. At the second hearing he will either contest the allegations that he violated or stipulate and hope for a learned Judge that will gives him a time-in sentence and released him.
