The file is not coveted yet and everything is in my name. Can I keep my car out it it? Ask can I gave up one of the cars? The bankruptcy payment will be shared? Thank you! I need an divorce lawyer.

Generally to not pay for your car through the Chapter 13, you need to be current on making the payments or surrender the car. Not sure why you would want to file a joint chapter 13 with a husband that is abusing you because in its own way, filing a joint chapter 13 is like hopping into bed together. If you want to hire a divorce lawyer, you should search for one using the "find a lawyer" search tool. Attorneys on this site are prohibited from soliciting for your business. See link below for more info. Hope this perspective helps!

It sounds as though you made the decision to file chapter 13 on your own and that you do not have a lawyer. If that is the case, I strongly suggest you seek a competent local attorney who can help you with your 13 or convert it to chapter 7 if that would've been the better option. If you had an attorney who 'disappeared' after your plan was confirmed, it's time to find a new bankruptcy lawyer. If your abusive husband is in the 13 with you, it may be in your interest to 'bifurcate' the case (split your two bankruptcies into two cases). Talk with the attorney about options for your car. You may be able to keep payments on it 'outside' the bankruptcy, though it still is a debt which must be listed. You can often save significant money on high-interest auto loans or older auto purchases by paying the loans 'through the plan.' If you need to budget to pay a divorce lawyer and you can otherwise manage it, you may be able to adjust your 13 payments to allow you pay for another attorney. In any case though, get competent legal counsel ASAP, Good luck to you!

The bankruptcy will prevent the divorce from finalizing on the financial matters until bankruptcy is finished. You should set up a consult with a family law attorney to obtain representation. Many offer free consults.

if you are the victim of abuse you can go to court and get an emergency order of protection against your husband.the bankruptcy will not prevent you from doing this.
