You will need to consult an immigration attorney to help you with this process. Is there a reason you haven't tried to help your husband adjust status? Are you a citizen or a permanent resident? There are a lot of details that an attorney will need in order to help you. Good luck!

Do you want to bring her with an immigrant visa as a legal permanent resident? If that's the case you can file a petition on her behalf provided that you married her father prior to her 18th birthday. If what she wants to get is a tourist visa to come to the United States to visit, she needs to apply for that visa herself at the consulate. Consult with an experienced immigration lawyer to evaluate the best strategy to follow on her case.

When applying for Visitor Visa, she will have to truthfully answer question on her visa application Whether She Has Any Relatives in the US and What is Their Status. By disclosing the fact that her father is in the US illegally, it is very probable that her Visitor Visa will be denied since the Consul will assume that because her father remained in the US illegally, she will do the same thing. But if she has plenty of evidence of ties to home country she can always try.... just so you know what she will be against and what her chances are. If it doesn't work, if you married her father before she turned 18, you can always file immigrant petition on her behalf. But the wait time is about 2 yrs if she is under 21 or 7 yrs if she is older .
